Terms of Use
The rules for using AllergyNest: what the site is and isn’t, how you may use our content and Google’s pollen data, and the legal terms that apply.
Policy update, October 28, 2026: you can now sign up for food allergen recall alerts by email. Our Privacy Policy, Consumer Health Data Privacy Policy and Terms of Use explain what a recall alert sign-up keeps, that alerts go only to confirmed addresses, and what the alerts can’t do.
October 19, 2026: doctors in our allergist directory, and the people who work at their practices, can now claim their listing. Our Privacy Policy, Cookie Policy and new Directory Listing Terms explain what a clinic account keeps. Readers still don’t need an account, and our pages still set no cookies for them.
October 17, 2026: you can now sign up for pollen alert emails. Our Privacy Policy and Consumer Health Data Privacy Policy explain what a sign-up keeps and how to delete it.
These terms cover your use of allergynest.com. AllergyNest is operated by Faz LLC (“AllergyNest”, “we”, “us”), a Wyoming limited liability company. By using the site, you accept these terms and the policies they link to. If you don’t agree, don’t use the site.
Our Privacy Policy explains what information we handle and why. All our policies are listed on our policies page.
What AllergyNest is, and what it isn’t
AllergyNest is a free information site for readers in the United States. It has pollen forecasts for US metro areas, guides to common allergens, food allergen recalls and a directory of allergists. Readers don’t need an account to use it.
Doctors in our directory, and people who work at their practices, can create a clinic account to claim and update a listing. Our Directory Listing Terms apply to clinic accounts as well as these terms.
AllergyNest gives general information. It is not medical advice, and it doesn’t diagnose or treat any condition. Our Medical Disclaimer explains more.
Using AllergyNest, or emailing us, does not create a doctor–patient relationship.
In a medical emergency, call 911 or your local emergency number.
Pollen forecasts
Our pollen forecasts come from the Google Pollen API. Each value is on the Universal Pollen Index, a scale from 0 to 5: None, Very low, Low, Moderate, High and Very high.
These values are modeled estimates from Google’s model. They are not measured pollen counts. Keep in mind that:
- They can be wrong. The pollen in the air where you are may be higher or lower.
- Each metro forecast is for a fixed location in that metro area, so conditions elsewhere in the area may differ.
- Values are refreshed on a schedule, not continuously, so a page may not show current conditions.
- Values can be missing or unavailable, for example if Google’s service doesn’t return them.
- Google’s terms let us keep values only for limited periods, so older values are deleted and may not be available.
- Coverage is limited to the 48 contiguous states and the District of Columbia. Alaska, Hawaii and Puerto Rico are not covered.
Use pollen forecasts as a general guide. Don’t rely on them alone for decisions about your health.
Food recalls and recall alerts
Our food allergen recall pages and recall alert emails come from FDA: the company recall announcements FDA posts on its website, and FDA’s enforcement reports. Keep in mind that:
- They don’t cover every recall. Not every recall has an announcement on FDA’s website, and meat, poultry and egg products are recalled through the USDA, so they aren’t included.
- We check FDA’s list every hour and send recall alerts once a day, so an alert can arrive hours after FDA posts a recall, or the next day.
- The allergen tags are ours, matched from the reason FDA gives. They can be wrong, so check the reason and the announcement.
- An alert is a summary. The announcement on FDA’s website has the lot codes, dates, where the product was sold and what to do with it.
Always read the label. Don’t rely on our pages or alerts alone to know whether a food is safe for you.
Google Maps content
AllergyNest includes Google Maps features and content. Our pollen values come from the Google Pollen API, which is part of Google Maps Platform.
Your use of Google Maps features and content is subject to the then-current Google Maps End User Additional Terms of Service and the Google Privacy Policy.
Pages that show Google’s values carry the credit line “Source: Includes pollen data from Google”. Figures we work out from those values carry the credit line “Includes data from Google Maps”.
Our servers request pollen values from Google on a schedule. Those requests carry no information about you, and your browser doesn’t contact Google when you view our pages.
See also Google’s general Terms of Service. Our own use of the Google Pollen API is governed by the Google Maps Platform Terms of Service. Some of the rules below, such as the limits on copying and reusing pollen values, are there because of those terms.
Using AllergyNest
You may use AllergyNest for your own information, at home or at work. You are welcome to link to any page and to share those links.
You may not:
- Scrape AllergyNest, or crawl it at a rate that burdens the site. Search engines may crawl and index our pages as our robots.txt file allows.
- Bulk-download, cache, store, republish, redistribute or resell pollen values or other content from AllergyNest. This doesn’t cover the temporary copies your browser makes to show you a page, or quoting as described below.
- Use pollen values outside AllergyNest, for example in another website, app, product, service, dataset or publication.
- Use our content to train, test or improve machine-learning or AI models without our written permission. Pollen values may never be used for this, and we can’t give permission for them.
- Try to break into, disrupt or overload the site, or probe or test it for vulnerabilities, except as our security policy allows.
- Reverse engineer the site, except where the law allows it despite this rule.
- Frame or embed our pages in a way that hides or removes our credits, including the credit lines for Google’s pollen data.
- Use the site in a way that breaks any law.
You may quote short excerpts of our text, with a link to the page and credit to AllergyNest. This doesn’t cover pollen values. For anything more, ask us first. Our Copyright and Trademarks page explains the details.
Who may use AllergyNest
AllergyNest is written for adults. It is not directed to children under 13, and we don’t knowingly collect personal information from children under 13. If you are a minor, use AllergyNest with a parent or guardian.
Our content and trademarks
The text, design, illustrations and other content on AllergyNest belong to Faz LLC or its licensors and are protected by copyright and other laws. The AllergyNest name and branding are trademarks of Faz LLC. Pollen values belong to Google and its licensors.
We give you a limited, personal, non-exclusive, non-transferable and revocable license to view AllergyNest for your own information, as these terms allow. We keep all rights we don’t expressly give you.
Links and sources on other sites
Our pages link to other websites, including the sources our guides cite. We don’t control those sites and aren’t responsible for their content, availability or practices. Their own terms and privacy policies apply. A link doesn’t mean we endorse a site, or that it endorses us.
Future features
We may add features such as articles by clinician contributors. Some features come with extra terms, which we will show you when you use the feature, such as our Directory Listing Terms for clinic accounts. If extra terms conflict with these, the extra terms apply to that feature.
Changes to the site and to these terms
We may change, add or remove parts of AllergyNest, or stop offering it, at any time.
We may update these terms. When we do, we will change the “Last updated” date on this page. If a change is material, we will say so on the site before it takes effect. If you keep using AllergyNest after a change takes effect, you accept the updated terms.
Disclaimer of warranties
ALLERGYNEST IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
In particular, we don’t promise that:
- the content is accurate, complete or up to date;
- pollen values are correct, or available for any place or day;
- the site will be available without interruption, secure or free of errors.
Some states don’t allow certain warranties to be excluded, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data or goodwill, arising from or related to AllergyNest or these terms. This applies even if we were told such damages were possible.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO ALLERGYNEST OR THESE TERMS IS LIMITED TO US$100.
These limits apply whatever the legal theory, whether contract, tort (including negligence), strict liability or anything else. They also protect our members, managers, employees and contractors.
Some states don’t allow these limits, so they may not apply to you. Nothing in these terms excludes or limits liability that can’t be excluded or limited under the law that applies.
Indemnity
If someone else brings a claim against us that arises from your breach of these terms or your misuse of AllergyNest, you agree to indemnify us. This means you will cover the reasonable costs and losses that result from that claim, including reasonable legal fees, to the extent the law allows. It applies only to claims that arise from your breach or misuse.
Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.
Any dispute about these terms or AllergyNest will be heard in the state or federal courts located in Wyoming, and you and we agree to the jurisdiction of those courts. If the law where you live gives you the right to bring a claim in your local courts, these terms don’t take that right away.
Nothing in these terms takes away rights you have under consumer protection laws that can’t be waived by agreement.
Suspending or ending access
We may suspend or end anyone’s access to AllergyNest, including by blocking traffic, if we reasonably believe they have broken these terms, or to protect the site and its readers. You may stop using AllergyNest at any time.
The parts of these terms that by their nature should continue after your use ends will continue. These include the rules on reusing content and pollen values, the disclaimer of warranties, the limitation of liability, the indemnity and the governing law.
General
- Severability. If a court finds any part of these terms unenforceable, that part will be applied as far as the law allows, and the rest of these terms stay in effect.
- No waiver. If we don’t enforce part of these terms, we haven’t given up the right to enforce it later.
- Entire agreement. These terms, together with the policies they link to, are the whole agreement between you and us about AllergyNest. They replace any earlier terms.
- Assignment. You may not transfer your rights or duties under these terms. We may transfer ours, for example if AllergyNest is sold or reorganized.
